Terms of service

These terms cover use of Pylon, a dispatch and timekeeping service operated by ScaleTechnics AI Solutions Inc. They are between ScaleTechnics and the company that uses Pylon to run its crews.

Who agrees to what

The customer is the traffic control company using Pylon. Its owners and admins accept these terms on its behalf when they set the company up. If you are a crew member, your login was issued by your employer; your use of Pylon is on your employer’s account and under its direction.

Accounts and access

A login belongs to one person. Do not share it, and tell the office if you think somebody else has it. The customer decides who has an account and what each person can see, and is responsible for keeping that list current — including removing people who leave.

The customer’s data is the customer’s

Crew records, jobs, shifts, time sheets, plans and messages entered into Pylon belong to the customer. ScaleTechnics stores and processes them to provide the service and for no purpose of its own. It does not sell them and does not use them to train anything. The customer can ask for an export of its data at any time while its account is open.

Using it properly

Do not use Pylon to:

• store information about people who have nothing to do with the work;
• attempt to reach another company’s records;
• probe, load-test or interfere with the service; or
• break the law with it.

What Pylon is not

Pylon records what the office and the crew enter. It is not a substitute for professional judgement about traffic control, and a traffic management plan produced or stored in it is the responsibility of the qualified person who prepared and signed it. Warnings the app shows — an expired ticket, a missing site orientation, too little rest between shifts — are prompts, not a certification that a placement is safe or lawful. The customer remains responsible for compliance with the BC Traffic Management Manual, WorkSafeBC requirements, the Employment Standards Act, and its own obligations as an employer.

Availability

We aim to keep Pylon running and to give notice before planned maintenance, but the service is provided as it is, without a guarantee of uninterrupted availability. Keep your own record of anything you cannot afford to lose.

Liability

To the extent the law allows, ScaleTechnics is not liable for indirect or consequential loss, or for lost profits, arising from use of Pylon. Nothing here limits liability that cannot be limited by law.

Ending it

The customer may stop using Pylon at any time and ask for its data back. We may suspend an account that is being used in breach of these terms, and will say why. On closure, data is kept for 30 days so it can be retrieved, then deleted.

Governing law

These terms are governed by the laws of British Columbia and the laws of Canada that apply there, and the courts of British Columbia have jurisdiction.

Changes

If these terms change materially, the customer will be told before the change takes effect. The date at the top always says when this version was published.
